The primary mission of the Zaa Institute for Private Training is to improve lives through training and learning. That is why our team works to enable anyone with sufficient training experience and the qualifications to provide distinguished content of real addition anywhere from creating and sharing educational content, and accessing this educational content for learning - which is the user.

You bear full responsibility for your account and everything that happens on it, including any damage to you or to the Zaa Institute for Private Training or to any other person, which is caused by someone using your account without your permission; Which means you need to be careful about your password.

You may not transfer your account to another person or use another person's account, and if you contact us to request access to your account; We will not grant you such access, unless you can provide us with the information we need to prove that you are the owner of this account.

You should notify us as soon as you become aware that someone else may be using your account without your permission, or if you suspect any other breach of security by contacting our support team, and we may ask you for some information to confirm that you are indeed the owner of your account.
if you are under the legal age of 16 to use the Online Services; You may not create an account, and if we discover that you have created an account that violates these rules; Our team will finish it.
Under our trainer terms; You may be asked to verify your identity before you are allowed to submit content for publication on Dhaa Institute for Private Training.

Content registration and lifetime access
when you enroll in a course or other content; You are obtaining a license from the Zaa Institute for Private Training to view it through its services and not for any other use; Do not attempt to transfer or resell the Content in any way.
In any case, we grant you a license to access the Content for life, except when we must disable the Content for legal or policy reasons or for registrations via subscription plans.
Under the terms of the trainer of the Zaa Institute for Private Training, when the trainers publish content on them; They give the institute a license to license the content to students; This means that we have the right to license the content to enrolled students.

This lifetime access license does not apply to enrollments through subscription plans or additional benefits and services associated with the course or other content for which you are enrolling; for example; Instructors may decide at any time not to provide instructional assistance or question-and-answer services in connection with the Content; The lifetime access is to the course content and not to the instructor.

Instructors may not license their content directly to students, and any such direct license shall be deemed null and void and in violation of these Terms.

Payments, credits and refunds

when you pay; You agree to use a valid payment method, and if you are not satisfied with the content; The Dhaa Institute for Private Training offers a 30-day refund or credit for most content purchases.

3.1 Pricing
Content prices on Dhaa Institute for Private Training are determined based on the terms of the trainer and our promotions policy, and in some cases, the price of the content displayed on the website of Dhaa Institute for Private Training may not be exactly the same as the price displayed on the mobile applications; Due to the pricing systems of the mobile platform providers and their policies regarding the execution of sales and promotions.

We sometimes run promotions and sales of our content, during which certain content is available at a discounted price for a specific period of time, in which case the price applied to the content will be the price at the time you complete the purchase of the content when you log out, and any price displayed for certain content when you sign up may also vary access to your account at the rate available to non-registered or logged-in users; Because some of our promotions are only available to new users.

If you are logged into your account; The currency listed you see is based on your location when you created your account, and if you are not logged into your account; The price currency depends on the country you are in; We do not enable users to see prices in other currencies.
if you are a student residing in a country where a sales and use tax, goods and services tax, or value-added tax applies to consumer sales; We are responsible for collecting that tax and remitting it to the appropriate tax authorities, and depending on your location; The price you see may include such taxes, or the tax may be added at checkout.

3.2 Payments
You agree to pay fees for the content you purchase, and you authorize us to charge your debit or credit card or process other payment methods such as Boleto, SEPA, direct debit or mobile wallet for those fees.
Dhaa Private Training Institute works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information safe.
We may update your payment methods using information provided by our payment service providers.

when you make a purchase; You agree not to use an invalid or unauthorized payment method, if your payment method fails and you can still access the content you are registering for; You agree to pay the corresponding fee to us within 30 days of notifying us, and we reserve the right to disable access to any content for which we have not received adequate payment.

3.3 Refunds and Refund Credits
If the content you purchased is not what you expected; You may request, within 30 days of your purchase of the Content, that Zaa Private Training Institute apply a refund to your account, and this refund option does not apply to purchases of subscription plans.
We reserve the right to apply your refund as a refund or refund to the original payment method, at our discretion, depending on the capabilities of our payment service providers, and the platform from which you purchased your content - the website or mobile application -.

if we ban your account or disable your access to Content because of your violation of these Terms or our Trust and Safety Guidelines; You will not be eligible for a refund.

3.4 Discounts and Promotion Codes
Dhaa National Training Institute or its trainer partners may offer gifts and promotional codes to students, and certain codes may be redeemed for gifts or promotional credits applied to your Dhaa National Training Institute account, which can then be used to purchase eligible content on our platform, in accordance with the Terms contained in your codes, and other codes may be directly redeemable for certain content, gifts or promotional credits cannot be used for purchases in the mobile applications.
These codes and credits, as well as any promotional value associated with them, may expire; If it is not used within the period specified in your Zaa Institute for National Training account.

Gifts or promotional credits offered by the Zaa Private Training Institute may not be returned for cash, unless otherwise stated in the terms included in your codes or as required by applicable law.
Promotional gifts or credits provided by the partner are subject to that partner's refund policies, and if you have multiple credits saved; Dhaa Institute for Private Training may determine which of the gifts or promotional credits apply to your purchase.

Content and behavior rules
You may only use the Zaa Institute for Private Training for legal purposes, and you are hereby responsible for all the content that you post on our platform.
You must keep reviews, questions, posts, courses, and other content you upload in line with our trust, safety, and legal guidelines, and respect the intellectual property rights of others.
We can ban your account for repeated or major infractions, and if you believe someone is infringing your copyright on our platform; So let us know.

You may not access or use the Services or create an account for illegal purposes, and your use of the Services and conduct on our Platform must comply with applicable local or national laws or regulations in your country, and you are solely responsible for knowing and complying with those laws and regulations that apply to you.
if you are a student; The Services enable you to ask questions to instructors of courses or other content for which you are enrolled, to post reviews of the content and, for certain content; The instructor may invite you to submit content as homework or tests; Do not post or send anything that is not yours.

if you are a coach; You can submit content for publication on the platform and you can also communicate with students who have registered for your courses or other content, in either case; You must abide by the law and respect the rights of others; You may not post any course, question, answer, review, or other content that violates applicable local or national laws or regulations in your country, and you are solely responsible for and the consequences of any courses, content, and actions you post or take via the Platform and the Services.
Make sure you understand all copyright restrictions set forth in the trainer's terms before submitting any content for publication on Dhaa Institute for Private Training.

if we are notified that your Course or Content violates the law or the rights of others; for example; If it is found to infringe the intellectual property rights or image rights of others, or relate to illegal activity, if we discover that your content or conduct violates our Trust and Safety Guidelines, or if we believe that your content or conduct is illegal, inappropriate, or objectionable , - for example if you impersonate another person -; We may remove your content from our platform on Dhaa Institute for Private Training because it does not comply with copyright laws.

Zaa Institute for Private Training has the discretion to implement these terms and our trust and safety guidelines, and we may restrict or terminate your permission to use our platform and services or block your account at any time - with or without notice - for any or no reason, including any Violation of these Terms.
If you fail to pay any fees when due, for fraudulent chargeback requests, at the request of law enforcement or government agencies, for extended periods of inactivity, or for unexpected technical issues or problems, and if we suspect that you are engaging in fraudulent or illegal activities, or for any other reason in our sole discretion.

upon any such termination; We may delete your account and your content, and we may prevent you from accessing the platforms and using our services.
Your Content may remain available on the Platforms even if your account is terminated or suspended.
if a user has posted content that infringes your copyright or trademark rights; Please let us know.
We have Terms for Coaches that require our coaches to follow the law and respect the intellectual property rights of others.

The rights of the Zaa Institute for Private Training in the content you publish
You retain ownership of the content you post on the Zaaa Private Training Institute, including your training courses, and we are permitted to share your content with anyone through any media, including promoting it via advertising on other Internet sites.
Content you post as a Student or Instructor, including Courses, remains your property, and by posting Courses and other Content; You permit Zaa Institute for Private Training to re-use and share it, but you do not lose any ownership rights that you may have over your Content.
if you are a coach; Make sure you understand the content license terms detailed in the Instructor Terms.

when you post content, comments, questions, and reviews, and when you send us ideas and suggestions for new features or improvements; You authorize Zaa Institute for Private Training to use and share this content with anyone, distribute and promote it on any platform and in any media, and make any modifications to it as we see fit.

In legal language - by submitting or posting content on or through the Platforms -; You grant us a worldwide, non-exclusive, royalty-free license - with the right to sublicense - to use, copy, reproduce, manipulate, adapt, modify, publish, transmit, display and distribute Your Content - including your name and image - in all media or distribution methods - existing or hereafter Developed later - This includes making your content available to other companies, organizations or individuals that partner with the Zaa Private Training Institute for sharing, broadcasting, distributing or publishing your content on other media, as well as using your content for marketing purposes.

using the Services; You may be exposed to content that it deems offensive, inappropriate, or objectionable. Zaa Institute for Private Training assumes no responsibility for maintaining such content from you and assumes no responsibility for your access or registration in any training course or other content, to the extent permitted by applicable law, and applicable This also applies to any content related to health, wellness and physical exercise.

when you use our services; You will find links to other websites that are not owned or controlled by us; We are not responsible for the content or any other aspect of these third party websites, including their collection of information about you; In this case, you must read their terms and conditions and privacy policies.

The rights of the Zaa Institute for Private Training
We own the ZAA Basic Training Institute system and services, including the website, current or future applications and services, and things like our logos, application programming interface (API), code, and content created by our employees, which you cannot tamper with or use without permission.
All right, title, and interest in Dhaa Private Training Institute and its services, our website, our current or future applications, APIs, databases, and content provided by our employees or partners or provided through our services - with the exception of content provided by trainers and students - will remain the exclusive property of Dhaa Training Institute Al-Ahly and its licensors.

Our Platforms and Services are protected by copyright, trademark, and other laws of both the State of Kuwait and the Gulf States.
Nothing gives you the right to use the Zaa Institute for Private Training name or any of the trademarks, logos, domain names, and other distinctive brand features of Dhaa Institute for Private Training.
Any observations, comments or suggestions that you may provide regarding the Zaa Institute for Private Training or the services, are completely voluntary and we will be free to use them.

You may not do any of the following while accessing or using the Zaa Institute for Private Training platform and services: -

* Access, tamper with, or use non-public areas of the Platform, including the storage of content, the electronic system of the Platform, or the technical delivery systems of its service providers.
Disable, interfere with, or attempt to circumvent any security-related features of our Platforms or scan or test vulnerabilities in any of our systems.
* Copy, modify, create a derivative work from, reverse engineer, reverse compile, or attempt to discover any source code or content on the Zaa Institute for Private Training platform or services.

* Access, search for, attempt to access or search for our Platform by any means - electronic or otherwise - through our currently available search functions, which are made available via our website, mobile applications or API, and in accordance with API Terms and Conditions Applications, and you may not scrape or use code or any other automated or electronic means of any kind to access the Services.

Subscription terms
This section covers additional terms that apply to your use of subscription-based groups as a Subscription Plans subscriber.

8.1 Subscription Plans

The subscription you purchase or renew determines the scope, features, and price of your access to the subscription plan, and you may not transfer, assign, or share your subscription with anyone else.
It should be noted that the equivalent of $1 may be deducted in some banks during the free trial period, and that is a normal procedure from payment service providers to ensure the validity of the card used only.

We reserve the right to revoke any license to use Content in our subscription plans for legal or policy reasons at any time and in our sole discretion; for example; If we no longer have the right to display the content through a subscription plan.

8.2 Account Management
You can cancel your subscription by following the steps described on our support page.
if you cancel your subscription to a subscription plan; Your access to this subscription plan will automatically end on the last day of the billing period, and upon cancellation, you will not be entitled to a refund or credit for any fees already paid for your subscription, unless otherwise required by applicable law.
to clarify; Canceling your subscription does not terminate your Zaa National Training Institute account.

8.3 Trials and Free Renewals
Your subscription may start with a free trial, the length of the free trial period for your subscription will be determined during registration.
Dhaa Institute for Private Training determines free trial eligibility at our sole discretion and may limit eligibility or duration. We also reserve the right to terminate free trial and suspend your subscription if we determine that you are not eligible.
We will charge the subscription fee for the next billing cycle at the end of the free trial period, and your subscription will automatically renew according to your subscription settings; for example; Monthly or annually, unless you cancel your subscription before the end of the free trial period.

8.4 Payments and Billing
The subscription fee will be listed at the time of purchase, and you can visit our support page to learn more about where to find the fees and the dates that apply to your subscription.
We may also be required to add taxes to your subscription fee as described in the “Payments, Credits, and Refunds” section above.
Payments are non-refundable and there are no refunds or credits for partially used periods, unless otherwise required by applicable law, and based on where you are located; You may be eligible for a refund.

to subscribe to a subscription plan; You must provide a payment method.

By subscribing to a subscription plan and providing your billing information during checkout; You grant us, and our payment service providers, the right to process payment for the applicable fee at that time via the payment method on record with us, and at the end of each subscription period, we will automatically renew your subscription for the same term and process your payment method for payment of the applicable fee at that time.
In the event that we update your payment method using information provided by our payment service providers - as described in the “Payments, credits and refunds” section above; You authorize us to continue to charge the applicable fee at that time to your updated payment method.

if we are unable to process the payment through the payment method on record with us, or if you submit a chargeback request that disputes the charge to your payment method and the chargeback is granted; We may suspend or terminate your subscription.
We reserve the right to change our subscription plans or adjust the pricing of our services at our sole discretion.
Any price changes will apply to your subscription upon notification to you, except as required by applicable law.

We make no guarantees as to the availability of any specific content, or any minimum amount of content, in any subscription plan, at any time in the future, and we reserve the right to offer or discontinue additional features for any subscription plan, or to modify or terminate the subscription plan at our discretion This disclaimer is in addition to those listed in the Disclaimer section below.

OUR LIABILITY AND THE LIABILITY OF EACH OF OUR GROUP COMPANIES, SUPPLIERS, PARTNERS AND AGENTS TO YOU OR ANY THIRD PARTY UNDER ANY CIRCUMSTANCES WILL BE LIMITED TO THE EXCESS OF THE MORE OF HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING UP your claims

9.4 Compensation

In cases where the “Dispute Resolution” section below does not apply to you; You consent to the exclusive jurisdiction and venue of the courts in the State of Kuwait.

9.6 Legal Processes and Notices
No action, regardless of form, arising out of or relating to this Agreement may be brought by either party more than one (1) year after the cause of action has accrued, except where such limitation cannot be imposed by law.

9.7 The relationship between us
You and we agree that there is no joint venture, partnership, employment, contractor or agency between us.

9.8 No Waiver
You may not assign or transfer these Terms or the rights and licenses granted under them; for example; if you register an account as an employee of a company; Your account cannot be transferred to another employee.
We may assign these Terms or the rights and licenses granted hereunder to another company or person without restriction, and nothing in these Terms will confer any right, benefit or compensation on any third party person or entity.
You agree that your Account is not transferable and that all rights to your Account and other rights under these Terms terminate upon your death.

9.9 Penal and Export Laws
You may not access, use, export, re-export, transfer, transmit or disclose - directly or indirectly - any part of the Services or any related technical information or material in violation of any trade sanctions imposed by the State of Kuwait and other applicable countries These laws, rules and regulations.
You agree not to upload any content or technology, including information about encryption, that is specifically export controlled under these laws.

Settlement of Disputes
in the event of a dispute; Our support team is happy to help you solve the problem, and if that doesn't work and you live in Kuwait or the Gulf countries; Your options are to go to small claims court or file a claim in binding arbitration, and you may not file that claim in another court or participate in a non-individual class action against us.
This section of dispute resolution only applies if you live in the State of Kuwait or the Gulf states, and most disputes can be resolved; So before filing a formal legal case; Please first try to contact our support team.

10.1 Small Claims
Either of us can bring a claim in small claims court in (a) the State of Kuwait (b) the country where you live, or (c) some other place we both agree on, so long as we are qualified to bring it to that court

10.2 Go to arbitration
If we cannot resolve our dispute amicably; You agree and Zaa Institute for Private Training to resolve any claims related to these Terms - or our other legal terms - through final and binding arbitration, regardless of the type of claim or legal theory.
If one of us files a lawsuit in court that must be arbitrated and the other party refuses to arbitrate it; The other party can ask the court to compel us to go to arbitration (commit arbitration).
Either of us can also ask the court to stay court proceedings while the arbitration is in progress.

10.3 The arbitration process
Any disputes involving a claim of less than $10,000 USD shall be resolved exclusively through binding, non-appearance arbitration.
The party choosing arbitration shall initiate proceedings by submitting a Request for Arbitration to the Kuwait Arbitration Association.
The arbitration proceedings are governed by the Kuwait Arbitration Association's Commercial Arbitration Rules, Consumer Legal Procedure Protocol, and Supplementary Procedures for Consumer Dispute Resolution.
You and we agree that the following rules will apply to the Procedures:-
(A) THE ARBITRATION WILL BE CONDUCTED BY TELEPHONE, ONLINE, OR WRITTEN REPORTS ONLY AT THE CHOICE OF THE PARTY SEEKING RELIEF-

(b) the arbitration shall not include any personal appearances by the parties or witnesses - unless you and we agree otherwise -
(c) Any judgment regarding the arbitrator's award may be entered into in any court of competent jurisdiction, and disputes involving a claim of more than $10,000 must be resolved in accordance with the Kuwait Arbitration Association's rules as to whether or not the arbitration should be held in person.

10.4 No Class Actions
We both agree that we can only bring claims against the other on an individual basis, which means:-
(a) Neither of us can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative proceeding.
(b) The arbitrator cannot consolidate the claims of several persons in a single case or preside over any consolidated, class, or representative proceeding.
(c) an arbitrator's decision or award in the case of one person can only affect that user, not other users, and cannot be used to decide other users' disputes, if a court determines that this "no class action" clause is not enforceable or valid; This "Dispute Resolution" section will be null and void, but the rest of the Terms will remain in effect.

10.5 Changes
Notwithstanding the "Updating these Terms" section below; If Dhaa Institute for Private Training changes this “Dispute Resolution” section after the last date on which you indicated acceptance of these Terms; You may reject any change by providing written notice from Dhaa Institute for Private Training of such rejection by mail or hand delivery to (Salmiya. Amman Street, Building No. 16, Office 2) and by e-mail from the e-mail address associated with your account to (@dhaa). dhaa.co), within 30 days of the effective date of such change, as indicated by the “last updated on” language above.
For the notice to be effective; It must include your full name and clearly indicate your intent to decline changes to the Dispute Resolution section.
